Preamble

This Personal Data Protection Policy (hereinafter referred to as the “Policy”) applies to the company WELCOME PRINTS S.A.S, with a share capital of €1000, whose registered office is located at 34 CR 316 du Beausset à Signes, 83330 Le Beausset. The purpose of this Policy is to inform Users about WELCOME PRINTS’ practices regarding the collection, processing, transfer, and storage of Users’ personal data.

The term “Personal Data”, as defined in Article 4 of the GDPR, refers to “any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more factors specific to their physical, physiological, genetic, mental, economic, cultural or social identity.”

Data Controller

The controller responsible for processing the Personal Data collected as part of the creation of a Seller or Buyer account, as well as during Users’ browsing on the Website, is the legal representative of www.welcome-prints.com, Morgane Garden.

Methods of Personal Data Collection

Information Provided by Website Users

To use the website www.welcome-prints.com and its various associated features, Users provide certain Personal Data, particularly when registering on the Site or placing product orders.

The Personal Data collected includes: name, surname, country, address, email, username and password, content of virtual shops, product descriptions, photos, order details; and buyers’ banking information for payment processing by our approved third-party provider (these payment details do not pass through the Site).

The Site may create one or more databases or processing files containing the information voluntarily provided in order to use one or more Services.

Information Automatically Collected

WELCOME PRINTS may collect and process certain data automatically from Users, including:

Connection and browsing data (Google Analytics, Facebook Pixel), which are anonymized upon collection;

Data automatically collected during website navigation (cookies). A cookie is information stored on the User’s hard drive or by a third-party server, allowing preferences to be saved and Users to be recognized through a unique identifier.

Purpose of Data Collection

www.welcome-prints.com collects and processes Personal Data from Buyers, Sellers, and Users in accordance with applicable laws and regulations, in particular the French Data Protection Act No. 78-17 of January 16, 1978 (“Informatique et Libertés”) and the General Data Protection Regulation (GDPR) effective from May 25, 2018.

By accessing the Site, every User agrees that WELCOME PRINTS may collect, store, process, and/or use their Personal Data as described herein.

The personal information collected by WELCOME PRINTS on the Site is essential for several purposes:

  • Management of User accounts
  • Facilitation of transactions between Buyers and Sellers through the Site
  • Administration of the services offered
  • Handling of online information requests
  • Sending of marketing communications to Users who have consented (e.g., emails following voluntary registration)
  • Administrative communication with Sellers
  • Tracking User activity on the Site
  • Improving services and preventing illegal activities
  • Dispute resolution and enforcement of the Site’s Terms of Use, including management of order-related conflicts

WELCOME PRINTS guarantees that Users’ Personal Data will not be processed for any other purposes than those stated above.

If WELCOME PRINTS were to process Personal Data for new purposes, this Policy would be updated and submitted for Users’ approval.

WELCOME PRINTS reserves the right to modify this Policy at any time and without notice to reflect changes in applicable law, the Site, or its operations. Updates will take effect upon online publication. WELCOME PRINTS reserves the right to deny access to the Site if this Policy is not accepted.

Users may access and save a copy of this Policy at any time on the Site.

Recipients of Personal Data

WELCOME PRINTS undertakes to take all necessary precautions to preserve the security of the information and prevent unauthorized disclosure.

Personal Data may be transmitted to WELCOME PRINTS’ subcontractors for Site operation
purposes, including:

  • Website hosting, maintenance, and security services (GANDI);
  • Emailing and SMS services (Mailjet);
  • Account verification, payment, and transaction processing services (STRIPE, WC VENDORS);
  • Website usage analysis services (Google Analytics, Facebook Pixel).

WELCOME PRINTS and its service providers guarantee a level of security compliant with current legal standards.
Personal Data is processed solely for the purposes defined by WELCOME PRINTS.

Subcontractors may not use it for other purposes without the explicit consent of the Users concerned.
Additionally, WELCOME PRINTS may disclose certain Personal Data to third parties due to legal obligations, to respond to claims against the company, upon request from a judicial or administrative authority, or in cases of legal requisition. Data may also be shared in emergencies concerning public health or physical integrity, or to protect the rights, property, and safety of Users and third parties.

Retention Period of Personal Data

WELCOME PRINTS retains Users’ Personal Data only for the time necessary to fulfill its intended purpose.
Personal Data is retained for a maximum of three (3) months from the closure of a Buyer or Seller account.
Cookies are retained for three (3) months.

After these periods, Personal Data is deleted and/or archived.

Seller Responsibility and Collection of Personal Data

     
Sellers may collect personal data (such as name, surname, postal or email address, and phone number) through the Site for the sole purpose of fulfilling and tracking product orders.

They acknowledge full responsibility for processing this data in accordance with applicable legal bases (consent, legitimate interest, legal obligation, contract execution, etc.).
Sellers may not process Personal Data for any other purposes — particularly commercial purposes (e.g., prospecting, resale) — without WELCOME PRINTS’ prior consent. Sellers release WELCOME PRINTS from all liability in this regard. Any violations may result in legal action by WELCOME PRINTS.

In the event of reciprocal data transfers between WELCOME PRINTS and Sellers, both parties agree to process such data solely for the purposes described above.

Sellers are strictly prohibited from using or disclosing any personal data collected through the
Site without the express prior consent of the data subject.

User Rights: Access, Rectification, and Objection

In accordance with applicable European regulations, Users of www.welcome-prints.com have the right to access, rectify, update, block, or delete their Personal Data if it is inaccurate, incomplete, ambiguous, outdated, or unlawfully collected, used, or retained.
